1. Who these terms are between

These Terms govern your use of www.yellowtreereading.com (the "Website") and anything you buy or book through it from Yellow Tree Reading (PTY) LTD, trading as Yellow Tree Reading Academy ("Yellow Tree", "we"). By browsing, creating an account, buying, or booking, you agree to these Terms and to our Privacy Policy. If you use the Website for a school or organisation, you confirm you are allowed to bind it to these Terms.

South African law applies, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA). If you buy from outside South Africa, the mandatory consumer law of your own country also applies and wins where the two conflict.

2. What we sell through this Website

As at this version, the Website offers:

• Digital resources — downloadable literacy games, activities and bundles, delivered as files in your account library after payment. Nothing is posted; see Delivery & refunds.
• Membership — access to the member resource library for the period you pay for (Root, Bloom, Grove or Canopy). See clause 6.
• Academy courses — online courses with video lessons and quizzes, accessed in your account after enrolment.
• Training events — live training sessions (online or in person) booked per seat. See clause 7.
• Free resources and community — free downloads, articles and the members' community feed.

The Processing Speed and Comprehension tools linked from this Website are separate applications with their own terms; these Terms do not cover them.

3. Accounts and age

Accounts, purchases and bookings must be made by an adult (18 or older). Our materials are made to be used with children, but a child does not need an account on this Website and we do not knowingly open one for a child. A parent, guardian or educator who uses our resources with a child is responsible for that use. Keep your sign-in email secure; you are responsible for activity under your account.

4. How a purchase happens

1. You add items to your cart or choose a training event and the number of seats.
2. You give the details we need to deliver: your name, email address and, for training, a phone number.
3. You are sent to PayFast (Pty) Ltd, a licensed South African payment gateway, to pay. We never see your card details.
4. A binding contract forms when PayFast confirms the payment to us and we send you a confirmation email. Contracts concluded this way are valid under Chapter 7 of ECTA.

Free items and free training events skip the payment step and are confirmed immediately. If a coupon takes an order below PayFast's minimum we will ask you to adjust the order.

5. Prices, currency and tax

Prices may be shown in ZAR, USD or EUR for your convenience. All payments are taken in South African Rand through PayFast; if you pay with a non-ZAR card, your bank converts the amount at its own rate and may add a fee. The amount payable, after any coupon, is shown before you confirm.

Yellow Tree Reading (PTY) LTD is [NOT CURRENTLY / CURRENTLY] registered for VAT in South Africa. Where we are registered, prices shown include VAT at the applicable rate. We do not collect VAT or sales tax for other countries; any import or use tax due where you live is your responsibility.

We may offer invoice or purchase-order payment for schools. Invoices you generate on the Website are pro-forma until we confirm them by email.

6. Membership

• Membership is bought for a stated period (monthly or annual as shown at purchase) and gives access to the member library for that period.
• [CONFIRM: memberships are billed as one-off payments for the chosen period and do not renew automatically. If a renewal mechanism is introduced, this clause, the checkout and the emails will be updated first.]
• Tiers with several learner or educator seats are licensed for that number of people. Use beyond the seat count needs a higher tier or a custom licence.
• You may stop a membership at any time; access continues to the end of the paid period. Section 14 of the CPA applies to South African consumers.

7. Training events

• A booking is for the number of seats you choose, for the date, time and venue (or online link) shown on the event page.
• Joining details for online events are sent to the email address you booked with.
• If we cancel or move an event, you may choose a full refund or a seat at the rescheduled session.
• If you cannot attend, tell us at support@yellowtreereading.com: seats may be transferred to a colleague at any time; refunds follow clause 8.
• Sessions may be recorded for attendees who could not make it. You will be told at the start of a session if it is being recorded; if you do not want to appear, keep your camera off.

8. Refunds and cancellations

8.1 Digital resources and courses

If you are not satisfied with a digital resource or course, email support@yellowtreereading.com within 14 days of purchase with your order reference and we will refund it in full. After that the sale is final, as permitted for digital content under section 42 and section 20 of the CPA.

8.2 Membership

The same 14-day full refund applies to a first membership payment. Later payments for further periods are not refundable, but you may simply not buy the next period.

8.3 Training events

Cancel [CONFIRM: 7] or more days before the event for a full refund; within [CONFIRM: 7] days you may transfer your seat or receive [CONFIRM: a credit toward a future event]. We always refund in full if we cancel or you cannot attend because of a technical failure on our side.

8.4 Faults and non-delivery

None of this limits your right to a repair, replacement or refund where something is faulty, not as described or not delivered. If you cannot see your purchase in your library within 2 hours of a successful payment, contact us and we will fix it or refund you.

8.5 How refunds are paid

Refunds go back through PayFast to the card or account you paid with, normally within 5 to 10 working days.

9. Licence to use our content

Buying a resource, membership or course gives you a personal, non-exclusive, non-transferable licence to use it for your own classroom, therapy practice, homeschool or teaching, for the number of learners your purchase covers. You may not share, copy, distribute, upload, resell or sub-license it, or use it beyond the licensed seat count. For school-wide or multi-school licensing, contact support@yellowtreereading.com.

10. Intellectual property

All content on the Website and in our resources, courses and training materials belongs to Yellow Tree Reading (PTY) LTD or its licensors and is protected by South African and international copyright law.

11. Acceptable use

Use the Website lawfully and for its intended educational purpose. Do not interfere with its operation, scrape it, attempt to reach other people's data, or post in the community anything unlawful, abusive or that identifies a child without permission. We may remove content and suspend or close accounts that break these Terms.

12. Community and reviews

Posts, comments and testimonials you submit may be shown on the Website with the name you give. You keep ownership of what you write and give us a licence to display it. You can ask us to remove your posts at any time through the data request form.

13. Warranties and liability

Every learner progresses differently. We stand behind the quality of our materials, but we do not promise specific educational or developmental outcomes, and nothing on this Website is a diagnosis or a substitute for professional assessment. Except where the CPA or the mandatory law of your country says otherwise, our content is provided as described and our total liability for any claim is limited to what you paid for the item concerned. We are not liable for indirect or consequential loss.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Disputes fall under the courts of South Africa, Western Cape Division, or a competent consumer body such as the National Consumer Commission (012 428 7000, www.thencc.gov.za). This does not take away any mandatory right you have where you live, including, for EU and UK consumers, the right to bring a claim locally.

15. Changes to these Terms

We may update these Terms. The version and date at the top change when we do, and earlier versions are kept on file. Material changes that affect an active membership or booking will be emailed to you before they take effect.
